With the constant evolution in the field of forensics, the scope of use of scientific evidences in court proceedings has also increased in the recent years. However, the use of expert testimony and forensic evidences in Indian courtroom is not as prevalent, and when used, is considered as secondary or corroborative in nature. There are also examples of scientific evidence being misunderstood or exaggerated, leading to wrongful convictions. There are many factors that contribute to this – this course will hope to illustrate the influence some of those factors, and provide suggestions and learnings to alleviate the misconceptions in the next generation of litigators. Recent studies have also scrutinized that forensic evidence presented in court by experts may be, in certain cases, scientifically indefensible. While Indian higher courts have shown considerable dexterity in their gatekeeping responsibilities, it is still non -uniform and evolving in its application. The Forensic Science Course at JGLS is intended to familiarize students with the close and necessary relationship between forensic science and the criminal justice system while encouraging an informed and critical perspective of approaching scientific evidences in regards to prosecution and defence strategies.
